Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the IngressIQ web application, mobile apps, and reports (together, the “Service”), operated by Tall House Building Systems Pty Ltd trading as IngressIQ (“IngressIQ”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service, and what it is not

IngressIQ is decision-support software for professionals who specialise in water ingress investigation and design. It models a water-ingress problem, ranks candidate causes on the evidence you record, and screens designs for risk. It presents ranked possibilities for a competent professional to confirm on site. It does not provide a definitive diagnosis, engineering certification, or professional advice, and it is not a substitute for your own professional judgement or for inspection by a suitably qualified person. You are responsible for the conclusions you draw and the reports you issue.

2. Accounts

You must provide accurate details and keep your login secure; you are responsible for activity under your account. Accounts belong to an organisation. The person who creates an organisation is its owner and may invite team members up to the organisation’s seat limit. You must be at least 18 and able to enter a binding contract.

3. Free trial and subscriptions

The free tier includes one inspection, and its report is marked “TRIAL VERSION” and carries IngressIQ branding. To run further inspections, remove the watermark, and use your own report branding, you subscribe. Subscriptions are per seat, billed monthly in advance in Australian dollars, and continue until cancelled. Prices are shown before you subscribe and may change on notice for future billing periods. Payment is processed by Stripe; by subscribing you also agree to Stripe’s terms.

4. Cancellation and refunds

You may cancel anytime from your account; cancellation stops future renewals and your subscription remains active until the end of the paid period. Fees already paid are generally non-refundable except where a refund is required by law, including under the Australian Consumer Law, whose guarantees cannot be excluded.

5. Acceptable use

You must not misuse the Service: no unlawful use, no attempts to breach security or access other organisations’ data, no reverse engineering except as permitted by law, no reselling or white-labelling the Service itself, and no uploading of content you have no right to use. You keep ownership of the inspection data and photos you upload; you grant us the licence needed to host, process, and render them into your reports.

6. Intellectual property

The Service, including the diagnostic engine, fault-tree content, and report templates, is owned by IngressIQ and protected by law, and aspects of it are the subject of a pending patent application. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. Reports you generate are yours to use in your professional practice.

7. Disclaimers and liability

The Service is provided “as is”. To the extent permitted by law we exclude all warranties not expressly stated here. Nothing in these Terms excludes rights you have under the Australian Consumer Law. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the Service or paying the cost of doing so. To the extent permitted by law we are not liable for indirect or consequential loss, or for loss arising from conclusions drawn from the Service’s output, which you are responsible for confirming.

8. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or misuse. On termination your right to use the Service ends; we may delete your data after a reasonable period, subject to our Privacy Policy.

9. Changes and contact

We may update these Terms; material changes will be notified in the app or by email, and continued use after they take effect is acceptance. These Terms are governed by the laws of New South Wales, Australia. Questions: [email protected].
